USDA Property Eligibility in Florida: Well Water Testing Requirements

In Florida’s rural housing markets, private wells are common. For Realtors guiding clients through a USDA loan in Florida, understanding the loan’s well water testing requirements is critical to avoiding last-minute issues. Homebuyers also need to know these standards upfront so they can plan for inspections and ensure their property qualifies.2025 Florida USDA Loan Property Eligibility: Well Water Testing Rules for Realtors and Homebuyers. USDA guidelines require that any individual water system owned and maintained by the homeowner comply with local or state health authority codes. If the local jurisdiction does not set specific rules, then the Environmental Protection Agency’s (EPA) maximum contaminant levels become the standard.

This means a water quality analysis must be performed by either the local health authority or a state-certified laboratory. Importantly, the Safe Drinking Water Act does not apply to private wells, so USDA loans rely on these local and state requirements to ensure water safety.

Beyond water quality, USDA also requires the well location to be measured for proper separation from the septic system. The distance must comply with the HUD Handbook 4000.1 or be approved by the state or local authority.

Additionally, wells should be located on the subject property whenever possible. If the well is located on an adjacent parcel, USDA requires documented water rights and a recorded maintenance agreement in the lender’s permanent file before it can be accepted as the primary water source.

USDA Property Eligibility in Florida: Shared Well Requirements

In some rural Florida properties, multiple homes may rely on a shared well or an off-site water facility. When this is the case, USDA guidelines require the lender to verify that the system provides a safe, continuous, and adequate supply of potable water.

For Realtors, it’s critical to recognize these shared well requirements early so your buyers aren’t caught off guard during underwriting.2025 Florida USDA Loan Property Eligibility: Well Water Testing Rules for Realtors and Homebuyers. Metroplex Mortgage Services #1 Ranked USDA Lender in Florida.

Here’s what USDA requires when a property is served by a shared well:

  • No feasible public connection: The homes must be located where connection to an acceptable public or community water system is not practical. Determining this falls on the lender.
  • Individual valves: Each dwelling that uses the shared well must have its own valve.
  • Number of homes served: A shared well may service up to four living units unless local code allows otherwise and enforces that approval.
  • Water quality: The water must meet state or local health authority requirements. If those are not defined, the EPA’s maximum contaminant levels apply.
  • Shared well agreement: A written agreement must:
    • Be binding on all current and future property owners
    • Be recorded (or scheduled for recording) no later than closing
    • Outline how maintenance and repair will be handled
    • Include provisions for cost-sharing
    • Provide a permanent easement granting access for maintenance and repairs
